Time to lawyer up?

It looks like that might be the way forward for the newly-minted Constitution Party.  Here’s their spokesman Joe Guarino:

Yesterday, I had reported here that the General Assembly’s override of Governor Cooper’s veto of “sore loser” legislation would potentially affect nominations the Constitution Party of North Carolina had already submitted to the North Carolina State Board of Elections (SBOE).

Today, we learned that SBOE staff had decided that three of our candidates cannot run for office even though an “ex post facto” law was being applied in flagrant violation of the United States Constitution. When we advised them that this is illegal, the staff basically told us that we can sue the Board if we didn’t like the outcome.

There has also been a recent pattern of Board non-responsiveness to inquiries and phone calls and questions. They are supposed to act as a resource to provide good customer service to North Carolina citizens, but they don’t seem to care.[…]

I’ve heard about non-responsiveness from board staff from folks affiliated with Republican campaigns, too.  They’ve got a clear customer service problem up there that spans beyond the boundaries of The Constitution Party.

It is extremely disappointing to witness this level of corruption within North Carolina state government.

This is all part of a disturbing trend of heavy-handedness sweeping across Raleigh in recent years — from parties taking away the rights of voters to pick candidates in judicial primaries to tinkering with judicial districts right up until the last minute to this “sore loser” nonsense.  WHY NOT let these people run? 

It’s interesting how folks weren’t so worried about this when the Greens got ballot access.

Supporters of capitalism make the claim all the time that competition makes everyone and everything involved BETTER.  Perhaps unfettered Constitution and Green parties (and their candidates) will help make the two major parties better.

  1. What are they afraid of? Perhaps our race against the progressive republican, Tillis, proved that a true constitutionalist could win. Our campaigns exposed the fraudulent premise that the republican establishment is the party of the constitution. It’s in propaganda only, never in action.
    What is the constitutional answer to stop federal government overreach in healthcare, education, abortion, basically everything they are doing today? Bind them to the constitution- True Federalism! Where are the so called conservatives in the state and federal governments now with a constitutional plan? The silence is deafening.
    Conservatives who want to use the powers of government to enhance their positions are just as bad as progressives. That is just the rule of men , not the American Experiment of a government based on God’s Natural law. The rule of man enslaves the individual, God’s Natural law frees the individual! When applied to each individual, society is at it’s best! That is why our form of government ( on paper) is a representative republic based on Federalism- Decentralization of power- that’s the American Experiment we are fighting for. Freedom over coercion, Liberty over compulsion.
    Thomas Jefferson “ the cornerstone of the constitution is the X Amendment.” Let’s find true oath keeping constitutionalist that understand these foundational principles to represent us at all levels of government. The we can truly be a state, a federal nation based on consent of the governed. The political class would be servant leaders , bound to the constitution, which frees the individual. That’s an American Experiment to show the world.

  2. Don’t lawyer-up. That’s just what the GOP wants, a possible competitor spending their limited time and resources fattening up some lawyers. Accept political reality and beat t.hem at their game. Spend your time and resources working to elect those candidates that survived the BOE massacre. Nothing would be more frustrating than to see a new party, with promise, falling on their own sword chasing after a point of law. Win a few seats and continue building or sputter out of existence fighting a years- long never-ending battle, away from your primary objective. Learn a lesson from other forever small parties.
    That the system is corrupt. You already knew that.

  3. It’s time for a new party when we have rhino like Richard Burr & Tom Tillis just a few to list. We have all three branches of government a great president & a lot of republican want help this great man. My wife & I have talk about leaving the republican party because of so many rhino. PS another rhino John McCain.
